Topic: Tax deducted in income accruing in India  XML

I am an NRI with income accruing in India. However, the TDS from my income is the maximum rate of tax at which relevant Income is taxable in India . I feel that my actual tax liability is lower than this. How can I solve this problem ?

By filing regular return of income, you can claim as refund the higher deduction of tax that has been made in your case.

In future you should estimate your income, tax liability and likely TDS and then apply for partial or complete Tax Exemption Certificate. In order to assist such situation, the Income-tax Act has provided procedure under section 197 whereby you can apply to the Assessing officer (in prescribed form) to issue specific certificate authorising the payer of income to deduct tax at a lower rate or nil rate. In future, the payer shall deduct tax in accordance with the certificate of the Assessing officer.
