Hi,
The employer can't hold back your form 16 and it is your right to ask for it. In case you are still not provided the form 16 you can file taxes using details from your payslip. You would need to fill in the normal ITR form – ITR1, if you have just salary and interest income or ITR2 if you have income apart from salaries.

Fill in your personal details, income details as well as details of your employer including name,address, tan number and how much taxes were deducted from your salary.
